The General Department of Customs has just issued a document guiding the declaration procedures. chemistry for imported pharmaceutical ingredients.
In the process of managing imported chemical goods, some local customs departments reported problems related to the requirement to present a "Chemical Declaration Certificate" issued by the Ministry of Industry and Trade for goods that are pharmaceutical ingredients.
According to the provisions of Clause 11, Article 1 of Decree No. 26/2011/ND-CP detailing and guiding the implementation of a number of articles of the Law on Chemicals, "before clearing chemicals, organizations and individuals chemical import responsible for declaring chemicals to the Ministry of Industry and Trade", however, there is no specific guidance on whether it is necessary to declare imported chemicals to the Ministry of Industry and Trade in the case of chemicals that are imported pharmaceutical ingredients that have been licensed by the specialized management agency, the Department of Drug Administration - Ministry of Health.
In order to have a basis to guide local customs departments to implement uniformly, the General Department of Customs has discussed with the Department of Chemicals (Ministry of Industry and Trade), which is the specialized management agency for this item. Based on the response of the Department of Chemicals, the General Department of Customs provides specific instructions on chemical declaration for imported pharmaceutical ingredients.
Specifically, businesses still have to chemical declaration with the Ministry of Industry and Trade in case of imported goods listed in Appendix V of Decree No. 26/2011/ND-CP of the Government amending and supplementing a number of articles of Decree No. 108/2008/ND-CP of the Government.
When carrying out procedures for importing chemical products, enterprises must declare chemicals to the Ministry of Industry and Trade and present an original copy of the Chemical Declaration Certificate issued by the Ministry of Industry and Trade to the Customs authority where import procedures are carried out.
